Clay's Background

Clay has over a decade of experience practicing employment law at large international firms in Dallas, Texas. He has represented a number of the country's largest corporations in significant, high-profile employment disputes.  


Clay litigates discrimination and retaliation claims and breach of contract matters. In particular, Clay's experience includes litigation and advice involving the Americans with Disabilities Act, the Family and Medical Leave Act, Title VII of the Civil Rights Act, the Railway Labor Act, the WARN Act, the Fair Labor Standards Act, the Age Discrimination in Employment Act, the Equal Pay Act, breach of employment agreement, trade secret misappropriation, and prosecution and defense of non-solicitation and non-compete covenants. 


Clay has first chair trial and arbitration experience. He has achieved numerous complete victories both at trial and pursuant to pre-trial dispositive motions. Clay also has substantial experience appearing before administrative agencies and judges on behalf of employers.

Representative Matters

   Litigation

  • Defended energy company in suit involving trade secret misappropriation and alleged improper "poaching" of employees from competitor, achieved full dismissal of lawsuit pursuant to Texas Citizens Participation Act Motion to Dismiss and award of $700,000.00+ in attorneys’ fees and sanctions for client (which appears to be the largest amount ever awarded under the Act), upheld on appeal
  • Achieved dismissal of retaliation and discrimination claims for clients prior to trial, including numerous dismissal orders at motion to dismiss and summary judgment stages
  • Secured multiple favorable judgments upon trying wrongful termination claims on behalf of employers
  • Defended compensation-related disputes, including favorable ruling for employer on disputed commission earnings 


   Advice 

  • Advised clients on a variety of employment-related topics, including, for example, vacation and sick leave, accommodations under the Americans with Disabilities Act, the Family and Medical Leave Act, background checks, compensation disputes, employment-related notifications and contractual violations, employee privacy rights, Artificial Intelligence, and Title VII issues
  • Drafted and revised employment-related offer letters and agreements, including restrictive covenant, confidentiality, and for-cause termination contractual arrangements 
  • Negotiated and drafted a wide variety of separation-related agreements
  • Counseled clients on investigation and reporting for internal employee complaints
